Youth help portal — terms of use

Full terms and conditions for The System · Youth help (0–24) static pages.

1. Operator and scope

These terms apply to the informational pages under /system/ (the “Youth help portal” or “The System” youth pages) published on The Fulcrum site by Malachai Grant, including related marks Universal Hierarchy (U|H). They sit beside the general Terms of use for the book site. If something in this document is more specific to the portal, this document prevails for the portal; the general terms still cover the rest of the site.

These pages are a static public noticeboard: rights language, official crisis numbers, and a map of real Australian agencies. They are not a government service.

2. Not legal advice, not medical advice, not a therapy service

This portal does not provide legal advice, medical advice, psychiatric advice, psychological advice, or therapy. Nothing on these pages diagnoses, treats, represents you in a proceeding, or replaces care from qualified clinicians, solicitors, Legal Aid, or headspace. Reading is not a consultation. If you are in distress, use the emergency and crisis contacts below — not this website’s owner.

The diligence disclaimer on the general terms applies here in the same voice: these pages are drafting aids and public information, not certified compliance and not solicitor sign-off.

3. Not a guardian, carer, nominee, or children’s lawyer

Neither The System, Universal Hierarchy (U|H), The Fulcrum, nor Malachai Grant is a legal guardian of any young person by visiting this site.

Visiting, reading, bookmarking, quoting, or relying on this portal does not make Malachai Grant, The System, The Fulcrum, or Universal Hierarchy (U|H) any of the following for any person:

Ages 0–17 are children in these terms; ages 18–24 are adults. Adults may still use the informational pages. Neither group obtains a guardianship, care, or representative relationship with the operator by using the site.

4. No personal information collected on these static pages

These portal pages contain no intake form and are not designed to collect names, addresses, dates of birth, school names, case numbers, or DCJ file numbers from anyone, including children. Do not type identifying information about a child into these pages, into Talk / AI Chat, or into an email to the diligence address unless an adult is asking a website-administration question that does not include a child’s file.

See the Youth help portal privacy addendum and the general Privacy notice.

5. Emergency and crisis contacts

If someone is in immediate danger, call 000.

Portal contact for a young person is those official services — not a personal message, DM, or visit to Malachai Grant. Adult diligence questions about the website itself may use legal@malachai.com (placeholder), the same address as the general terms. That address is not a counselling line, not a child-protection helpline, and not a place to lodge a case.

6. Mandatory-reporting honesty

NSW has mandatory reporter rules for certain occupations and services when they provide care or receive disclosures in the course of that work. This static portal does not take reports. Opening a page, following a crisis link, or reading rights information is not a report to DCJ and does not notify DCJ through this site.

If a future registered service (for example a staffed counselling or casework service with its own lawful authority) is ever stood up under another set of terms, NSW mandatory reporter rules may apply to that future service. That hypothetical service is not this static portal. Until such a service exists and is clearly labelled, treat these pages as information only.

7. What this portal does not claim

This portal does not start, file, or prosecute a court case against DCJ, NDIS, NDIA, “CPS,” police, a school, or a “Ministry of Youth.” There is no federal Ministry of Youth that this site can petition into existence. The pages do not appoint an ICL, do not create NDIS access, and do not authorise a carer.

8. Acceptable use

The general acceptable use rules also apply.

9. Licence to read

You may access and read the portal for personal, educational, and non-commercial use. You may share official crisis numbers freely. You may quote short passages with attribution to Malachai Grant and The Fulcrum under ordinary fair dealing / fair use norms. You may not republish the portal as if it were a government service or a finished legal product.

10. Disclaimer of warranties

The portal is provided “as is.” To the extent permitted by Australian consumer law, no warranties are made that the agency map, rights language, or any later compiled JSON notes are complete, error-free, or fit for a particular professional purpose. Agency phone numbers and names can change; confirm with the agency.

11. Australian Consumer Law — non-excludable rights

Nothing in these terms excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law or other non-excludable law that cannot lawfully be excluded. Where liability can be limited and the service is of a kind ordinarily acquired for personal, domestic, or household use, liability is limited (at the operator’s option, where permitted) to resupply of the information or payment of the cost of resupply.

12. Limitation of liability

Subject to non-excludable law, Malachai Grant is not liable for indirect or consequential loss arising from use of this free public informational portal. Cap any remaining liability at AUD 0 for unpaid access, or the amount you paid specifically for site access in the prior 12 months (if any), as in the general terms.

You use crisis numbers, Legal Aid, headspace, and other third-party services under those services’ own terms. This site does not control them.

13. Governing law

These terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have non-exclusive jurisdiction, without limiting any non-excludable consumer forum rights.

14. Changes

The operator may update these terms by publishing a new dated version on this page. The date at the top is the version date. Continued use after publication is acceptance of the updated terms.
